Terms and Conditions
These Terms and Conditions apply to your use of TheSupplyRun website and all purchases made through our online store.
By accessing our website, creating an account or placing an order, you agree to these Terms and Conditions.
1. Products
TheSupplyRun sells products including sneakers, sealed trading card products and accessories.
We make reasonable efforts to ensure product descriptions, photographs, colours, sizes, specifications and prices are accurate. However, colours and appearance may vary slightly because of lighting, photography, packaging changes and device display settings.
Product packaging may differ from promotional images where a manufacturer updates its packaging without changing the underlying product.
All products are subject to availability.
2. Sealed products
ALL SEALED PRODUCT IS 100% AUTHENTICALLY SOURCED. Trading card booster boxes, packs and other sealed products contain randomly inserted cards. Unless expressly stated in the product description, purchasing a sealed product does not guarantee:
- Any specific card;
- A particular rarity or pull rate;
- A complete set;
- A particular resale value; or
- A particular grading result.
Manufacturer pull rates, card distribution and packaging are controlled by the manufacturer and may vary.
Minor factory imperfections to external wrapping or packaging may occur. Any significant damage known to us will be disclosed where reasonably possible.
Opened trading card products are generally not eligible for change-of-mind returns because the contents have been revealed and the product can no longer be sold as sealed. This does not limit your rights where a product is faulty, materially damaged, incorrectly supplied or otherwise fails to meet a mandatory consumer guarantee.
3. Pre-orders
Products marked “pre-order” are not immediately available for dispatch.
Release dates and expected arrival dates are estimates based on information supplied by manufacturers, distributors and freight providers. These dates may change for reasons outside our reasonable control.
Payment may be taken when the pre-order is placed unless the product page or checkout states otherwise.
If a pre-order experiences a material delay, we will make reasonable efforts to notify affected customers and provide updated information. Any cancellation or refund options will be handled according to the product listing, our Returns and Refund Policy and applicable consumer law.
If we cannot obtain sufficient stock to fulfil a pre-order, we may cancel the affected order and issue a refund to the original payment method.
In-stock products ordered together with pre-order products may be held until the entire order is available unless otherwise stated in our Shipping Policy.
4. Dropshipped and separately fulfilled accessories
Some accessories may be shipped directly by a third-party supplier or fulfilment partner.
Where an order contains products fulfilled from different locations, the products may arrive in separate packages and at different times. This does not change our responsibility as the retailer or remove any rights available under applicable consumer law.
Relevant delivery information is provided in our Shipping Policy.
5. Prices and currency
Prices are displayed in the currency shown on the website or at checkout.
New Zealand customers will generally be charged in New Zealand dollars unless otherwise stated. Australian customers may be shown or charged in New Zealand or Australian dollars depending on the checkout configuration and selected payment provider.
Currency conversions displayed by third-party services may be estimates. Your bank or payment provider may charge foreign transaction or currency conversion fees.
Applicable taxes, delivery charges and other fees will be shown at checkout where required and reasonably available.
We may change prices at any time, but price changes will not affect an order that we have already accepted unless there has been an obvious pricing error.
6. Orders and acceptance
Submitting an order does not automatically mean we have accepted it.
After you place an order, you will normally receive an automated order confirmation. This confirms that we have received your order, but it does not necessarily confirm final acceptance.
We may reject or cancel an order before fulfilment where reasonably necessary, including where:
- A product is unavailable;
- There is an obvious pricing or product-information error;
- Payment cannot be authorised;
- We reasonably suspect fraud or unauthorised payment activity;
- The delivery address is incomplete or unsupported;
- Purchase limits have been exceeded; or
- We cannot lawfully fulfil the order.
If we cancel an order after payment has been received, we will refund the affected amount to the original payment method.
We may apply reasonable purchase limits to limited-release, high-demand or pre-order products. Attempts to bypass these limits may result in cancellation.
7. Payments
Payment must be made using one of the methods offered at checkout.
Payments may be processed by Shopify or another third-party payment provider. We do not directly store complete payment-card details.
You agree to pay all charges shown at checkout and confirm that you are authorised to use the chosen payment method.
Orders may be delayed or cancelled if payment is reversed, declined, disputed or identified as potentially fraudulent.
8. Promotions and discount codes
Promotions and discount codes are subject to any additional conditions displayed with the offer.
Unless otherwise stated:
- Discount codes cannot be exchanged for cash;
- Only one discount code may be used per order;
- Codes cannot be applied retrospectively;
- Codes may exclude selected releases, pre-orders or limited products; and
- Promotions may be changed or withdrawn before an order is placed.
We may cancel a discount or order where a promotion has been used fraudulently or contrary to its stated conditions.
9. Shipping
Delivery locations, timeframes, tracking, separate shipments and other delivery conditions are set out in our Shipping Policy.
We currently ship to eligible addresses in New Zealand and Australia. Available destinations and delivery services are confirmed at checkout.
International customers are responsible for reviewing any import requirements that apply in their country. Customs duties, import taxes or carrier charges may apply where they are not collected at checkout.
Nothing in this section limits our obligations under applicable consumer law.
10. Returns, refunds and faulty products
Returns, exchanges, cancellations and refunds are governed by our separate Returns and Refund Policy.
Nothing in these Terms or our Returns and Refund Policy excludes, restricts or modifies rights that cannot legally be excluded.
For New Zealand consumers, products come with protections under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
For Australian consumers to whom we directly offer and supply products, rights and remedies may also apply under the Australian Consumer Law. These statutory rights apply in addition to any voluntary store or manufacturer warranty.
11. Website accounts
You are responsible for keeping your account information and password secure and for activity conducted through your account.
You must notify us promptly if you believe your account has been accessed without permission.
We may suspend or close an account where we reasonably believe it has been used fraudulently, unlawfully or in a way that materially disrupts our website or other customers.
12. Acceptable website use
You must not:
- Use the website for unlawful or fraudulent purposes;
- Attempt to interfere with the website’s security or operation;
- Introduce malicious software or harmful code;
- Scrape, copy or reproduce website content without permission;
- Use automated systems to bypass purchase limits;
- Provide false or misleading information; or
- Infringe our rights or the rights of another person.
13. Intellectual property
Unless otherwise stated, website content created by TheSupplyRun—including branding, original photographs, written descriptions, graphics and page layouts—is owned by or licensed to us.
Brand names, product names, logos and trademarks belonging to manufacturers or other third parties remain the property of their respective owners.
You may use our website for personal shopping purposes. You may not reproduce or commercially use our original content without written permission.
14. Third-party services and links
Our website may use or link to third-party services, including Shopify, payment processors, delivery providers and social media platforms.
Those services may have their own terms and privacy practices. We are not responsible for third-party websites that we do not control.
15. Privacy
We collect, use, store and disclose personal information in accordance with our Privacy Policy and the New Zealand Privacy Act 2020.
Our Privacy Policy explains what information we collect, why we collect it, how it may be shared and how customers can request access to or correction of their personal information.
16. Limitation of liability
Nothing in these Terms excludes or limits any liability, guarantee, right or remedy that cannot legally be excluded or limited.
To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential loss that was not reasonably foreseeable when the order was accepted.
We are not responsible for loss caused solely by circumstances outside our reasonable control, provided that we have taken reasonable steps to minimise the effects and comply with our legal obligations.
17. Events outside our control
We are not responsible for delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, transport disruption, industrial action, border delays, government restrictions, supplier disruption or widespread network failures.
Where such an event affects an order, we will make reasonable efforts to communicate with the customer and provide an appropriate solution consistent with applicable law.
18. Complaints and disputes
If you have a concern about an order or our service, please contact us first so we can attempt to resolve it.
Email: support@thsupplyrun.co
Please include your name, order number and a clear description of the issue.
These Terms are governed by New Zealand law, except where mandatory consumer laws in another jurisdiction apply.
Nothing in these Terms prevents a consumer from using any court, tribunal, dispute-resolution service or regulator available to them under applicable law.
19. Changes to these Terms
We may update these Terms from time to time to reflect changes to our store, services or legal obligations.
Updated Terms will be published on this page with a revised “Last updated” date. Changes will not apply retrospectively to an order already accepted unless required by law or agreed with the customer.
